TERMS OF SERVICE
Custody terms should be as clear as the custody chain.
This public summary describes the intended service model. It is not yet the final service agreement.
1. Service scope
Everkeep intends to provide physical custody of customer-owned encrypted storage media. The service does not include cloud storage, remote file access, legal document custody, password recovery or decryption.
2. Customer responsibilities
- Use the service lawfully and retain control of passwords and recovery information.
- Prepare media according to the current intake guide and provide accurate contact information.
- Maintain a separate key-recovery plan; physical backup does not protect against key loss.
3. Intake and custody
Media is assigned a custody number, recorded by manufacturer serial number, photographed, sealed and placed under a documented custody process. When two matching copies are accepted, they are intended to be stored separately.
4. Access and instructions
Access may be provided by permanent return, an approved temporary loan or a supervised reading-room session. Future-dated return, forwarding and destruction instructions remain subject to notice, confirmation and recorded human review. Silence does not authorize forwarding or destruction.
5. Fees, renewal and overdue custody
Annual custody is $199 per device slot. The signed agreement governs charges, renewal, grace periods, overdue handling, contact attempts and any pre-authorized destruction process.
6. Liability and legal process
Final limits, insurance language, force-majeure allocation, Ontario law and dispute terms require counsel review. Everkeep intends to respond to valid legal process while accurately stating that it does not hold customer decryption keys.
